Pay stub requirements in Florida

Florida is one of the states with no pay stub law at all. No statute requires an itemized wage statement, and no statute tells private employers how often to pay — Chapter 532 governs only how wages may be handed over. What Florida does have is a minimum wage written into its constitution that steps up every September 30 rather than every January 1, reaching $15.00 on September 30, 2026 before inflation indexing takes over in 2027.

What Florida law requires

  • The statutes govern the device, not the arithmetic

    No Florida statute makes an employer hand over a wage statement or break out what was deducted. The chapter that governs paying wages is titled Devices Issued in Payment for Labor and lives up to it: even its oddest section, the 1915 rule on coupons and tokens handed out in lieu of money, is about the thing given rather than the arithmetic behind it. An employee covered by the Fair Labor Standards Act sees only what the federal payroll record holds.

  • Minimum wage rises every September 30

    Voters approved the schedule in November 2020. The rate reached $14.00 on September 30, 2025 and increases to $15.00 on September 30, 2026. From 2027 it is adjusted annually for inflation.

  • Tipped direct wage is the minimum minus the 2003 tip credit

    Florida Commerce calculates the direct hourly wage for tipped employees as the state minimum wage less the allowable FLSA tip credit of 2003, which is $3.02. Against the $14.00 rate that is a direct wage of $10.98, and the employer still has to make up any shortfall if tips do not carry the employee to the full minimum.

    Section 448.109, Florida Statutes, requires employers who must pay the Florida minimum wage to post the state notice conspicuously in every establishment where those employees work. The notice is published in English, Spanish and Creole.

  • The paycheck itself must be good for cash on demand

    Section 532.01 requires that a payment instrument be negotiable and payable in cash, on demand, without discount, at an established place of business in Florida, and that the payor keep sufficient funds for at least 30 days after issuing it.
