Pay stub requirements in Wyoming

Wyoming writes its stub rule as a deductions rule bolted to a calendar. Section 27-4-101 makes every employer, at the time of each payment of wages, furnish a detachable part of the check, draft or voucher giving an itemized statement in writing showing all deductions made from those wages, or supply the same statement on a slip attached to the payment. The calendar is fixed by date rather than by interval: wages earned in the first half of a month are paid on or before the first of the next, and those earned in the second half on or before the fifteenth. The state minimum wage is still five dollars fifteen cents, which matters only where the federal act does not reach.

What Wyoming law requires

  • An itemized statement of deductions, attached to the payment

Every employer shall, at the time of each payment of wages, furnish each employee with a detachable part of the check, draft or voucher paying the wages, giving an itemized statement in writing showing all deductions made from those wages. If the employer does not make payroll payments in that manner, it shall provide the itemized statement on a slip attached to the payment instead.

  • Paydays fixed to the first and the fifteenth

Employers in railroads, mines, refineries, oil and gas work, and other factories, mills and workshops shall pay on or before the first day of each month the wages earned during the first half of the preceding month, and on or before the fifteenth the wages earned during the second half. If the first or the fifteenth is not a working day the last preceding working day is payday, and the law itself must be posted in at least two conspicuous places.

  • Direct deposit only where the employee volunteered it

Nothing in the semimonthly payment sections prohibits an employer from depositing wages due, wages to become due, or an advance on wages to be earned into an account at a bank, savings and loan association, credit union or other authorised financial institution, but only if the employee has voluntarily authorised that deposit.

  • Five fifteen in the statute, two thirteen for tipped work

Section 27-4-202 requires wages of not less than five dollars and fifteen cents per hour, with two dollars and thirteen cents for tipped employees provided wages and tips together reach the applicable minimum, and four dollars twenty-five cents for employees under twenty during their first ninety consecutive days. Tipped employees must give their employer the daily tip record the federal rules already require of them.

  • Federal coverage lifts the number to seven twenty five

The U.S. Department of Labor lists the Wyoming basic minimum rate at $5.15 per hour and then adds the sentence that matters for most workplaces: employers subject to the Fair Labor Standards Act must pay the current federal minimum wage of $7.25 per hour. The state figure governs only the employees the federal act leaves out.

  • Agriculture sits outside the pay schedule

Agricultural operations are exempt from the semimonthly payment provisions, so the fixed first and fifteenth calendar and the itemized deduction statement attached to it do not reach farm payrolls. The separate minimum wage sections have their own scope and their own two-year record-keeping duty.

  • Two years of records, kept on the premises

Every employer subject to the minimum wage act shall make and keep, for not less than two years in or about the premises where an employee works, a record of the name, address and occupation of each employee, the rate of pay, the amount paid each pay period, and the hours worked each day and each work week.

What this generator calculates for Wyoming

Wyoming levies no personal income tax on wages, so a stub built here shows federal income tax, Social Security and Medicare, and leaves the state income tax line at zero because there is nothing to withhold.
